Kano Multi-Door Court Grants Woman Land Possession After 3 Years Dispute Against Husband

A Kano Multi-Door Courthouse (KMDC) has issued a writ of possession for a landed property in Gaida Geza, Kumbotso LGA, Kano. The property was awarded to Rabi’a Abdullahi Sarki Dori, the applicant, against her husband Ibrahim Adam, the respondent, who claimed ownership.

According to the Terms of Settlement signed by Alternative Dispute Resolution (ADR) Judge of Kano State, Justice Maryam Ahmed Sabo, as sighted by Justice Watch News, the house was awarded to her after she and her father took an oath before the Upper Shari’a Court, Filin Hockey, as part of the settlement proceeding.

Earlier, the Applicant, Rabi’a, on the 27th Sept.2024 wrote a petition to Kano State Chief Judge against her husband, Ibrahim Adam seeking her intervention against her husband’s alleged assault, infidelity, molestation and breath of trust.

On 1st Nov, 2024 The case was referred to Kano Multi-Door Courthouse from, judicial service for settlement amicably, thereafter, the parties appeared before the Courthouse, under the Mediator, Yahaya Muhammad Sani.

The both the parties agreed to resolve their dispute on terms as follows:

Having regard to the fact that the parties to the case are still husband and wife and they have been together for good 14 years and they were blessed with seven children. The Respondent contended that if the Applicant and her Father can go to any Shari’a Court and testify and swear to the Almighty Allah that they are the rightful owner of the property situated at Gaida Geza Kumbotso LGA Kano State he will accept and agreed that he has no any right interest whatsoever over the said property in dispute”

Immediately on the 25th November, Rabi’a and her Father appeared in Upper Shari’a Court filin hockey and took oath.”

According to the settlement, the terms constitutes the definitive agreement of the parties on the subject matter hereof and supercedes, cancels, and annuls all prior agreements, understandings, representations and undertakings relating to the subject matter hereof

Rabi’a Abdullahi has expressed her gratitude to Kano Chief Judge, Justice Dije Aboki, for her role in securing the writ of possession from the court. Abdullahi praised the judiciary, stating that it exists to serve the common people and provide mercy. She also thanked her family for their unwavering support and encouragement throughout the process.

When reached for comment, Ibrahim Adam confirmed that he accepted the resolution provided by the Multi-Door Courthouse.

He explained that since his wife and her father swore on the Holy Quran that the property belonged to them, he chose not to contest it further.

Adam prioritized the well-being of their seven children, opting to avoid escalating the issue and instead agreed to the court’s settlement.
