UPDATE: Court Restrains Bayero, 4 Others from Parading Selves as Emirs Over Kano Emirate Tussle

A Kano State High Court presided over by Justice Amina Adamu Aliyu has perpetually restrain Alhaji Aminu Ado Bayero and Four other dethroned Emirs from parading themselves as Emirs of Kano, Bichi, Rano, Gaya, Karaye.
Delivering the judgment today, the Court further restrain the 15th Emir of Kano and four other Emirs whosoever by  themselves, servants, privies and any other  persons appointed by them from parading themselves as Emirs of Kano, Bichi, Gaya, Rano, Karaye.
The Attorney General of Kano State, Kano State House of Assembly and its Speaker instituted the case seeking  the court interpretation on whether the Kano State House of Assembly by virtue of the provision of section 4 of the Constitution of Federal Republic of Nigeria 1999 as amended has the power to make, amend or repeal any law.
The Applicants further asked the court to interpret weather by virtue of the provision of section 5 of the Constitution of Federal Republic of Nigeria, 1999 as amended the Governor of Kano State has the power to assent to any bill made by the House of Assembly.
Justice Amina upheld that the submissions made by counsel before her strongly affirmed that the Kano State Emirate Council (Repeal) Law 2024 followed a due process and further affirming it as valid and duly assented.
She further said her position was pursuant to the position of section 4, 5, 7, (a and b) and 101 a and b of the Constitution of Federal Republic of Nigeria 1999 as amended.
She also declared the action of security agencies of smuggling Alhaji Aminu Ado Bayero to Nassarawa Emir Mini Palace as flagrant violation and disobedient to the Law of the land.
She stated, in flagrant violation and disobedient to the Law, the Security Agencies, include,: Police, NSCDC, Army, DSS smuggled in the defendant into the state to cause chaos and disorder in the state.
The Act of smuggling the 15th Emir of Kano Alhaji Aminu Ado Bayero after Kano State Emirate Council (Repeal) Law 2024 was ultra vires to the constitution and their constitutional power to provide peace and order in the state.” She however stated.
Justice Amina similarly ordered the 15th Emir of Kano, Alhaji Aminu Ado Bayero and Four other dethrone emirs of Bichi, Rano, Gaya Karaye to relinquish all the Emirship Symbol  of Authorities belonging to 5 emirates.
Justice Amina also set aside the earlier leave granted for defendants counsel to walk out from court during the court proceeding held on the 4th July, 2024.
She maintained that the Counsel didn’t complied with laid down procedure to recuse themselves from the trial.
She emphasized that the Counsel needed to apply on notice and serve all the parties involved not orally as in the instance case.
She further declared their motions pending before  court for hearing as abandoned and struck out.
“It is unfortunate how the lead senior lawyers in this case conduct their case based on sentiment. I consider the act of a lawyer as indiscipline for abandoning his client when the case is almost completed” she stated.
