UPDATE: Court Sets Aside Kano Govt’s Decision to Reassigned Emir Sanusi

A Federal High Court in Kano on Thursday set aside all steps taken by Kano State government to repeal the Kano Emirates Council Law 2019.

In his ruling on Thursday, Justice Abdullahi Muhammad Liman set aside the action of Kano government, ordering parties to maintain status quo.

Alhaji Aminu Babba Dan’agundi Sarkin Dawaki Babba approached the court asking for the Kano State Emirate Council (Repeal) Law 2024 to be nullified, claiming that he was not accorded fair hearing in his capacity as kingmaker during the process of repealing the law.

Delivering the ruling, seeking to set aside the Kano State Emirate Council Law 2024, the presiding judge, Justice AM Liman upheld that although the Kano State House of Assembly has the constitutional power to make, repeal or amend any law, adding that the Kano State Governor also has the legal power to act and seek for the repeal of any law established by Kano State House of Assembly.

The presiding judge, Justice Abdullahi Muhammad Liman however voided all the processes taken during repealing the law “I hereby order that every step taking by the Government is hereby nullified and becomes null and invalid and that this does not affect the validity of the repealed Emirates Law but actions taken by the Governor, which includes the assenting to the Law and the reappointment (of Sanusi).

“I have listened to the audio of the governor both in Hausa and English after assenting to the Law, and I am convinced that the respondents are aware of the order of maintaining status quo pending the hearing and determination of the motions on notice in the court.

“Having been satisfied that the respondents are aware of the court order, the court in exercise of its powers set aside an action because it is in violation of the court’s order”

He stated that court orders are meant to be followed.

Justice Liman further ordered all parties to maintain the status quo ante.

Additionally, the court has granted the respondents’ application for a stay of proceedings, pending the hearing and determination of a related case on jurisdiction at the Court of Appeal.

Consequently, the case has been transferred to Federal High Court 3 for further proceedings.
